Procedure of Court Marriage if both are Hindu

  • “Notice for Marriage” is needed to be submitted to the SDM of the District or State/Marriage Registrar. Either one of the parties must be a resident of the same state (at least from last one month)
  • The notice must be given in the newspaper as well.
  • Marriage Notice is published or put-up by the SDM.
  • After 30 days from the date of notice submission, the marriage must be solemnized. However, it can only take place if there is no objection by any person within these 30 days.
  • Marriage will only be solemnized at the Marriage Registrar office.
  • Both parties along with 3 witnesses must be present in the Marriage registrar’s office on the date of registration.

Conditions for Court Marriage

Under Section 4 of The Special Marriage Act, the following rules are listed for court marriages in India:

  1. The parties must meet the necessary conditions as listed in the act before signing the Civil Marriage Contract.
  2. Neither of the parties should already be in a marriage while applying for the court marriage. If the previous spouse is deceased or divorced, then the court marriage can be obtained.
  3. The parties entering the court marriage procedure must be doing so at their own free will i.e. there should be no pressure made on them for doing the same and neither of the parties should be of an unsound mind while entering into theprocedure of court marriage.
  4. Court marriage can only take place if both the bride and groom are of age as legally accepted in India i.e. for the bride it should be 18 years and above and for the groom it should be 21 years and above.
  5. The parties to the marriage should not fall within the degree of prohibited relationship.

Apply in-Person:

  1. Marriage registration has to be applied with the respective registrar in whose jurisdiction the husband or wife resides.
  2. Marriage certificate issuance authorities in Indore are Sub-Divisional Magistrate (SDM) office, local Municipal Corporation/municipality office, thasildhar/thasildhar office, revenue department office or through the panchayat.

  2. In the given page please select menu option “Citizen Services › Marriage Registration › Marriage Registration” to get the next page.
  3. In the next page please hit “click here to apply” option to reach successive page.
  4. Here, complete the prompt for “Select your city” and hit “Continue” to get next page.
  5. This page prompts user to enter details for certificate, uploading documents, selection of choices as prompted and finally hit “Continue” after making necessary selections.
  6. After completing the application, Please make payment as applicable. Once the payment has been made successfully, acknowledgement number and payment receipt will be given to the applicant through the registered email id and mobile.
  7. Please submit it to the registrar office in your area (ward office to the concerned authorities) and follow their guidelines to complete the registration.

Required Documents

Eligibility for Court Marriage
  • Eligibility age to get married is 21 for male and 18 for female.
  • Marriages solemnized under any personal law can be registered.
  • A marriage which has already been solemnized can be registered either under the Hindu Marriage Act, 1955 or under the Special Marriage Act, 1954.
  • The Hindu Marriage Act is applicable in cases where both the husband and the wife are Hindus, Buddhists, Jains or Sikhs, or in cases where they have converted into any of these religions.
  • In case either the husband or the wife or both are not Hindus, Buddhists, Jains or Sikhs, the marriage is registered under the Special Marriage Act, 1954
  • The charge will vary, if registered after two months (or specified period of time) of marriage date.

Note:You cannot apply for marriage certificate if you have not attained the age limit as this will be treated as offence.

Marriage certificate

After signing the declaration, the marriage officer will issue a marriage certificate. The marriage certificate will have to be signed by the parties and three witnesses. Upon signing of the document, the marriage certificate will be issued to the couple.
